DeFiBase Terms of Service

Welcome to DeFiBase! These Terms of Service ("Terms") govern your access to and use of the DeFiBase platform, websites, applications, APIs, and related services (collectively, the "Service"). Please read them carefully. By accessing or using the Service, you agree to abide by these Terms and our Privacy Policy.

1. Acceptance of Terms

By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not access or use the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract. You represent and warrant that: (a) you meet these eligibility requirements; and (b) you will comply with these Terms.

3. Definitions

"User", "you", "your": Any individual or entity accessing or using the Service.

"Wallet": A self-custodial digital address generated or connected through the Service.

"Transaction": Any send, swap, bridge, vault deposit, or other on-chain interaction initiated via the Service.

"Third-Party Protocols": External smart contracts and services integrated into DeFiBase (e.g., Stargate, Pendle, Morpho).

4. Account and Wallet

Passkey & Recovery: You may create a Wallet using passkey authentication and optional social recovery. You are solely responsible for securing your passkey/device and recovery methods.

No Custody: DeFiBase does not control or hold private keys for your Wallet. You maintain full control and responsibility over your assets.

Restrictions: You agree not to: (a) attempt unauthorized access; (b) share your passkey or recovery credentials; (c) use multiple accounts to manipulate promotions.

5. Transactions

User Initiation: All Transactions are initiated by you and signed on your device. DeFiBase facilitates, but does not execute on-chain operations.

Fees: You acknowledge and agree to pay any network fees, relayer fees, or service fees disclosed at the time of transaction.

Third-Party Protocols: Transactions may interact with Third-Party Protocols. You assume all risks associated with those protocols, including smart contract failures.

6. Prohibited Activities

You shall not use the Service to:

• Engage in illegal, fraudulent, or abusive transactions.
• Violate applicable laws, regulations, or sanctions.
• Distribute malware or malicious code.
• Interfere with or disrupt the Service or servers.

7. Intellectual Property

All content, logos, trademarks, and software on the Service are the property of DeFiBase or its licensors. You may not reproduce, modify, or distribute any content without prior written consent.

8. Disclaimers

No Financial Advice: The Service is for informational purposes only and does not constitute financial, legal, or tax advice.

"As Is": The Service is provided "as is" and "as available." DeFiBase disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, DeFiBase and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, or loss of revenue, profits, or data arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless DeFiBase and its officers, directors, employees, and agents from any claim, loss, liability, or expense arising from your use of the Service or violation of these Terms.

11. Modifications

We may modify these Terms at any time. We will post the updated Terms on our website with a new "Last updated" date. Your continued use after changes constitutes acceptance.

12. Termination

We may suspend or terminate your access at our discretion, with or without cause, and without notice. Sections on Disclaimers, Limitations, Indemnification, and Governing Law survive termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. Any dispute shall be resolved in the courts of Madrid.
